A title agent, or settlement officer, acts on the behalf of all parties involved in real estate transactions. Lenders require that title agents conduct settlements; prior to settlement, the title agent will order a title abstract as well as a land survey for the subject property. The lender wants to insure that all liens against the property will be paid-off with the proceeds of the settlement. The title agent will also order title insurance for both the lender and buyer. If for some reason a lien against the property is not disclosed during a title search, title insurance will protect the lender and or property owner. Once settlement is complete, the title agent will record the necessary legal documents with the local and state government.
